Baker County Library District (BCLD) is committed to maintaining a safe, respectful, and orderly environment for all patrons, volunteers, and staff. Access to District property may be restricted as authorized by Oregon law and District policy.  Conduct on District property may also be subject to applicable federal and state laws and local ordinances.

When necessary, BCLD may issue a Notice of Exclusion because of serious or repeated conduct on library property that:

• Violates the BCLD Patron Code of Conduct [PDF];
• Disrupts normal library operations;
• Creates a safety concern; or
• Interferes with the rights of others to use and enjoy the library.

When notified by a library staff member, an excluded individual must leave library property immediately. The individual may not re-enter any BCLD building or grounds during the designated exclusion period. Exclusion periods typically range from one day to one year, depending on the seriousness of the conduct and any prior violations.

CONDITIONS OF EXCLUSION
Unless otherwise authorized in advance by the Library Director, an excluded individual may not enter, remain on, or access any BCLD building or grounds in Baker City, Haines, Halfway, Huntington, Richland, or Sumpter during the exclusion period.

SUPERVISED-ACCESS EXCEPTION FOR MINORS:   An exclusion notice issued to a person under age 18 permits visits under the direct supervision of a parent or legal guardian.  Before visiting, we recommend calling 541-523-6419 to confirm the conditions of supervised access.

LEGAL CONSEQUENCES
Entering or remaining on District property in violation of an exclusion notice may constitute Criminal Trespass in the Second Degree under ORS 164.245. Staff may contact law enforcement regarding an active exclusion or a suspected violation of an exclusion notice.

Violating an exclusion notice or committing another violation of the Patron Code of Conduct may result in a new or extended exclusion period. 

RESTORATION OF ACCESS
Unless additional restrictions have been imposed, access is automatically restored when the exclusion period ends. To avoid additional violations, individuals should call 541-523-6419 to confirm the expiration date before returning.

RIGHT TO APPEAL
Individuals have the right to appeal an exclusion. If the excluded individual is under age 18, the appeal must be submitted by the individual’s parent or legal guardian. The Library Director may accept an appeal from another responsible adult when exceptional circumstances prevent a parent or legal guardian from submitting it.

To begin an appeal, submit a written request to the Library Director within 14 calendar days after receiving notice of the exclusion.  A person subject to an exclusion of seven days or fewer may request expedited review.

The exclusion remains in effect during the appeal process unless the District determines otherwise. The District will provide a written response within five business days after receiving the appeal.
